YOMODE

Terms of Service

1. Who we are and what these terms cover

YOMO is operated by Pascal Koch, Rotenwaldstraße 19, 70197 Stuttgart, Germany ("YOMO", "we"). Contact: contact@getyomo.com.

These terms apply to your use of the YOMO app and website. How we handle personal data is described in our Privacy Policy. YOMO is in beta. We work to keep YOMO available but cannot promise uninterrupted availability.

2. Who can use YOMO

You must be at least 16 years old to use YOMO. Gifts and anything else involving money require you to be at least 18.

Your account is personal. Give accurate information and keep your login and devices secure.

3. Your account and wallet

You sign in through our login provider Privy with e-mail or a passkey. A wallet is created for you; YOMO currently uses only the Base Sepolia test network. YOMO's servers do not hold your private key. The app signs with it without asking each time, but only for YOMO features you trigger yourself (for example circle membership, badges or gifts). You can export your private key in the app.

If you lose every way to access your account (e-mail, passkeys, devices), we cannot restore your wallet, and anything recorded on it is out of reach. Records on a blockchain are public and cannot be undone.

4. Your moments and who sees them

Every moment is saved in your private Diary, which only you can see. You can also share it with your Friends, a private circle or, once available, a public circle. Moments shared with Friends or a private circle are end-to-end encrypted for that audience; YOMO cannot see them (section 10 explains the one exception, a report). Moments in a public circle can be seen by everyone who opens that circle.

Whether a moment shows the place, you decide for each post before you post it. You can always post without a place.

5. Your rights in your content, and the licence you give us

You keep all rights in your moments, captions and comments.

You give YOMO a non-exclusive, non-transferable, royalty-free licence to reproduce (store), transmit and make your content available to the audiences you choose, to process it technically as far as that requires (encryption, previews, backups), including through our technical service providers, and to review reported content under section 10. The licence ends when you delete the content or your account, except for copies that were already delivered to your audience.

We do not sell your content and do not license it to anyone. A moment may only ever be licensed commercially (for example to a brand) with the explicit consent of the poster for that one moment and of every identifiable person in it. In the app, a request from a brand to use your moment under such a licence is called a “feature offer”.

6. What is not allowed

Do not post, send or tag anything that:

Do not interfere with YOMO (malware, scraping, getting around security or limits). You are responsible for having the rights and the consent of the people shown in what you post.

7. Tags and reposts

You can tag people who are in the audience of a moment. The person you tag is told and can remove the tag at any time.

A person you tagged may repost your moments only after you have accepted their request once; your yes then applies to every moment you tag them in, and they can repost only into their Friends. You can take your yes back at any time and turn reposts off for your moments altogether. If you delete your moment, its reposts are removed too: the app of each person who reposted it removes their copy once it learns of the deletion.

8. Circles and badges

Circle owners set their circle's rules and badges. A badge is a recognition, not a payment; YOMO promises nothing with it. Some badge and membership records are currently written by us to the public Base Sepolia test network, where they are publicly visible and cannot be deleted.

9. Gifts (test operation) and other money features

Gifts are currently in test operation. They run only on the Base Sepolia test network with a test token that is shown as "€" but has no monetary value and cannot be exchanged for real money. You may give and accept gifts only if you are at least 18. A gift goes directly from the giver's wallet to the recipient; YOMO holds no money and is not a party to it. If a host announces a gift on a badge, that is a voluntary announcement by the host, not a promise by YOMO and not a claim against YOMO.

Features with real money — such as real gifts or offers from brands — will only be offered under separate terms that you see and accept beforehand.

10. Reporting content, moderation and appeals

Reporting. In the app, report a moment via "···" → "Report moment". Anyone, with or without an account, can also use the form at getyomo.com/report or write to contact@getyomo.com. Please say where the content is, why you think it is illegal or breaks these terms, your name and e-mail address (optional for reports of child sexual abuse), and confirm that your information is accurate to the best of your knowledge. We confirm that we received your report and tell you what we decided.

How we decide. Every report is decided by a person at YOMO, carefully, objectively and proportionately. We may hide a moment, restrict who can see it, or suspend or close an account (section 11).

Automatic pause. Until a person has decided, a moment is automatically paused in the circle where it was reported if (a) two different people who have been members of that circle (for Friends: friends of the poster) for at least 24 hours report it within seven days, (b) the circle's owner reports it, or (c) someone reports that it shows the sexual abuse of a child. A pause applies only in that circle; in cases (a) and (b) it ends after at most 72 hours, in case (c) only with our decision. Your other circles, your Diary and your account are not affected. A person three of whose reports we decided were unfounded within 90 days no longer triggers a pause; we still review their reports.

Statement of reasons and appeal. When we act on your content or account, or an automatic pause applies, you receive a statement of reasons in the app: what we did, why, on which rule or law, whether automated means were used, and how you can challenge it. You can appeal a decision to hide a moment within six months, once per decision, in the app ("Ask for a review"); for other decisions, write to contact@getyomo.com. A person reviews every appeal. You can always go to court.

Encrypted moments. Moments shared with Friends or a private circle are end-to-end encrypted. We can only see such a moment if someone who can see it makes it accessible to us in a report; a person at YOMO then looks at that one moment, and only that one.

Trust Score. The app shows a Trust Score. It is calculated from your active days, your best streak, your account age, your badges and the number of your moments we have hidden.

Authorities. We report information about criminal offences that threaten people's life or safety, and about the sexual abuse of children, to the competent authorities.

11. Ending the contract, suspension

You can delete your account at any time in Account → Delete account; this ends the contract. We may end the contract with two months' notice, for example if we discontinue YOMO. For serious or repeated breaches of these terms we may temporarily suspend an account or end the contract for good cause. Before we do, we tell you the reason and give you the chance to respond; we then decide again. Only where this cannot reasonably be expected because of particular urgency do we do so immediately afterwards. Before the contract ends you can save your moments in the app; what happens to your data is explained in the Privacy Policy.

12. Liability

YOMO is provided in beta and free of charge. We are fully liable for intent and gross negligence, for injury to life, body or health, and where the law requires it, in particular under the Product Liability Act. For slight negligence we are liable only for breaches of essential contractual obligations, meaning obligations whose fulfilment makes the proper use of YOMO possible in the first place and on whose observance you may regularly rely, and only up to the damage typical for the contract and foreseeable. We are not liable for damage caused solely by you losing access to your account or wallet, or solely by third-party networks such as a blockchain, to the extent we are not responsible for it; our liability under the second sentence of this section remains unaffected.

13. Changes to YOMO

We may change YOMO for a valid reason, such as new features, security, technical developments, new legal requirements or the end of the beta. This costs you nothing, and we inform you clearly in the app about the change. If it impairs your access to or use of YOMO more than insignificantly, we inform you in good time beforehand, and you may end the contract free of charge within 30 days of the information or of the change, whichever is later. We provide the updates needed to keep YOMO in conformity with the contract.

14. Changes to these terms

New terms apply to you only if you expressly agree to them in the app. We show you the new terms beforehand and explain what changes. If you do not agree, the previous terms continue to apply; we may then end the contract with two months' notice under section 11. Until then you can save your content and delete your account.

15. Governing law, language and contract text

Governing law: the law of the Federal Republic of Germany. If you are a consumer, the mandatory protections of the country you live in still apply.

These terms are available in English and German; both versions are equally binding. If they differ, the version more favourable to you applies. If a provision is invalid, the rest remains in force.

We store the version you agreed to, with its date. You can view and save the current terms at any time at getyomo.com/terms. The contract languages are German and English.

16. Right of withdrawal

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded (the day you agree to these terms). To exercise the right of withdrawal, you must inform us (Pascal Koch, Rotenwaldstraße 19, 70197 Stuttgart, Germany, e-mail contact@getyomo.com) of your decision to withdraw from this contract by an unequivocal statement (for example an e-mail). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we shall reimburse all payments received from you without undue delay; as YOMO is free of charge, there are none. The contract ends, and you owe us nothing. Deleting your account within the period has the same effect.

Model withdrawal form (complete and return this form only if you wish to withdraw from the contract): To Pascal Koch, Rotenwaldstraße 19, 70197 Stuttgart, contact@getyomo.com: I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service (*): use of YOMO — Concluded on (*) — Name of consumer(s) — Address of consumer(s) — Signature of consumer(s) (only if this form is notified on paper) — Date. (*) Delete as appropriate.

About this website

Information about YOMO

This website presents YOMO and planned developments. You can visit without an account. Visiting does not create a contract for app membership, a licence, a payment or a brand pilot. The app is governed by the terms above; any subsequently agreed pilot services have separate terms, provided before a contract is concluded.

Beta, pilot and examples

Features labelled “Pilot”, “Soon”, “Planned” or “Coming soon” are not generally available yet. Examples illustrate possible flows; they are not binding offers or promises of availability, earnings or release dates. Example brands, people and figures in demonstrations do not represent actual partnerships or measured results. Gifts, payments and commercial offers are for adults only, if and when those features are offered. Photo book ordering and delivery are not offered here.

Content and rights

Text, design, photographs and other content may be protected by copyright or other rights. Display on this website does not grant a licence to reuse user images or brand material. Uses permitted by law remain permitted. Any later commercial use of community moments requires a separate agreement and, where applicable, additional image and personality rights.

Contact and corrections

For questions, errors or potential rights infringements, contact contact@getyomo.com. Visitors’ statutory rights remain unaffected. These notices do not limit statutory liability.
